Lasting Power of Attorney

Lasting Power of Attorney

Whether you are making a Lasting Power of Attorney (LPA) to plan for your future or looking to register an LPA for someone else, the specialist solicitors at Farnworth Rose can provide the advice and support you need.

What is a Lasting Power of Attorney?

A Lasting Power of Attorney is a legal document which allows someone to appoint a person (or more than one person) to act as their attorney. Once the LPA has been registered, an attorney will be able to make decisions for a person should they be incapable of doing so themselves. There are two types of LPA:

  • Property and Financial LPA

  • Health and Welfare LPA

Why should you make a Lasting Power of Attorney?

It is often difficult for us to consider what might happen should we be unable to manage our own affairs.

However, one of the most important aspects of making a Lasting Power of Attorney is to plan for your future whilst you are still in good health. For many people, it can be reassuring to know that a person you trust can make decisions on your behalf in the future.

If you do not have an LPA in place, a friend or relative may need to apply to the Court of Protection to become your Deputy. This can often be incredibly costly and time-consuming, leading to difficulties paying bills or making a decision on your future care.

How can Farnworth Rose help you draft your LPA?

By choosing an experienced solicitor, you can have peace of mind that your LPA will be valid and protect you in the future.

To ensure that your LPA will be valid, you must show that you have the mental capacity to make the LPA. A ‘certificate of capacity’ form must be signed by a professional such as your doctor, a social worker or a solicitor.

Our solicitors will discuss your needs with you to ensure any LPA is valid and reflects your needs and wishes. This can include who you would like to act as your attorney and how you would like them to manage your affairs.
